ACCEPTANCE OF TERMS
The services that AEI provides to you are subject to the following Terms. AEI reserves the right to update the Terms at any time without notice to you. The most current version of the Terms can be reviewed by clicking on the "Terms and Conditions" hypertext link.
The AirBag Center web site is the private property of Ascunce Enterprises, Inc. otherwise known as AEI. AEI authorizes you to use the web site solely for the purpose of buying and locating recycled airbags. Without limitation, you are not authorized to make the Information available on any website or otherwise reproduce, distribute, copy, store, use or sell the information for commercial gain without the express written consent of AEI. This is a personal service, thus your right to use the web site or information is non-assignable. Any access or use that is inconsistent with these terms is unauthorized and strictly prohibited.
All content of this site is protected property of Copyright © 2017 AEI. Material may only be printed from this site for the sole purpose of doing business with AEI Corporation. Any other use of materials on this site, including reproduction for purposes other than those expressly stated above without the prior written permission of AEI is strictly prohibited.
MEMBER ACCOUNT, PASSWORD, AND SECURITY
Our service requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. We will choose a temporary password and a username for you. It is your responsibility to change that password on your next attempt to log in. You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify AEI immediately of any unauthorized use of your account or any other breach of security. AEI will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by AEI or another party due to someone else using your account or password. You may not use anyone else's account at any time, without the permission of the account holder. Account holders agree that when acting on behalf of a third party to register or make a purchase on our website they do so with the authority of the third party or card holder in question and that they have explained our terms and conditions and therefore transfer all responsibilities of our terms and conditions to the third party. It is the customer's responsibility to update his account if and when his address changes and unless otherwise requested in writing all orders are shipped to the current address on the account.

The links in this area will let you leave AEIs site. The linked sites are not under the control of AEI and AEI is not responsible for the contents of any linked site, or any changes or updates to such sites. AEI has no affiliations with these companies and therefore you surf at your own risk.
Due to the constant changes in airbag recalls we encourage everyone to contact NHTSA to verify whether your vehicle is on a recall list or not. We guarantee that at the time of purchase all our airbags in inventory have been checked against the NHTSA online database for recalls or updated by a manufacturer authorized agent dedicated solely to updating recalled airbags. However, since we are not the manufacturer and we rely solely on the record keeping from the NHTSA.gov’s website and the process in place by each independent manufacturer we take no responsibility in how they handle this process. By accepting our terms and conditions you agree that you will hold AEI harmless (as per the section titled "HOLD HARMLESS") in the event that any airbag purchased from our company results in any bodily injury or death.
AEI is not a manufacturer of airbags or any of the accessories related to such safety equipment and therefore makes no claims as to the reliability of any of the used air bags or accessories you purchase at our store or web-site. All recycled airbags are sold as is. Customer is responsible for taking airbags to have them inspected and approved by a certified installer. You agree that you will not hold AEI liable for any damages or injuries that may occur from a faulty airbag or any accessory purchased from our company as per section titled (HOLD HARMLESS). No liability is assumed by AEI. In addition if you purchase a service that is outsourced to another company you agree not to hold AEI liable for any issue related to that service or performance of such part.
BY SIGNING OUR INVOICE, RECEIVING A PACKAGE FROM OUR COMPANY OR CLICKING ON THE "I AGREE" BUTTON YOU ARE AGREEING TO BE BOUND BY OUR TERMS AND CONDITIONS AND THEREBY INDEMNIFY AND HOLD HARMLESS AEI FROM ANY AND ALL ACTUAL OR ALLEGED CLAIMS, DEMAND, CAUSE OF ACTION, LIABILITY, LOSS, DAMAGE AND/OR INJURY (TO PROPERTY OR PERSONS, INCLUDING WITHOUT LIMITATIONS WRONGFUL DEATH), WHETHER BROUGHT BY AND INDIVIDUAL OR OTHER ENTITY OR IMPOSED BY A COURT OF LAW OR BY ADMINISTRATIVE ACTION OF ANY FEDERAL, STATE OR LOCAL GOVERNMENT BODY OR AGENCY ARISING OUT OF OR INCIDENTS TO ANY ACTS, OMISSIONS, NEGLIGENCE OR WILLFUL MISCONDUCT OF ANY AEI PRODUCTS OR SERVICES, ITS PERSONNEL, EMPLOYEES, AGENTS, CONTRACT HELP, OR VOLUNTEERS IN CONNECTION WITH OR ARISING OUT OF AEI PERFORMANCE, PRODUCTS OR SERVICES. THIS INDEMNIFICATION APPLIES TO AND INCLUDED WITHOUT LIMITATIONS THE PAYMENT OF ALL PENALTIES, FEES, JUDGMENTS, AWARDS, DECREES, ATTORNEYS FEES AND RELATED COSTS OR EXPENSES.
Any information provided to AEI will only be used for the purpose of providing you with either a product or service at your request. We will not contact you unless you are requesting information from our company. We do not share this information with any other third party and your e-mail address is not sold or used for any other purpose. If you register to receive promotional information we include an unsubscribe feature in compliance with CAN-SPAM Act.
LOST PACKAGES WHILE IN TRANSIT
If your package is lost during shipping, you agree that you will allow 10 business days for the shipping company to conduct an investigation in the attempt to recover the package. You also agree not to process a chargeback until the 10 days have elapsed. If a chargeback occurs prior to the completion of the investigation and it is found that the product was delivered you may enquire restocking fees as well as any package recovery fees if the order was canceled.
All services performed at our location are a final sale and therefore no refunds will be provided. Services include module reset services and seat belt repair services.
DAMAGED OR MISSING ITEMS FROM PACKAGES
If the shipping company hands you a damaged, open or partially open package you agree that you will report it immediately to the driver and document it in writing. In addition, in the event you accept a damaged package and then find that the items are damaged or missing, you agree that you will hold onto the box and its content. You agree that you will contact the shipping company immediately and cooperate with them to provide any information pertinent to their investigation. In addition you will hold onto all packaging and content for any length of time or until the shipping company picks them up and inspects the items for processing your claim. You understand that if you discard the box and or packaging and then make a claim for the missing or broken content it is possible that the respective shipping company will not award you any money and therefore no refund or credit will be issued to you by Ascunce Enterprises, Inc. In addition, if you take possession of a package, whether by signing or receiving it at your shipping address you agree that you must open and report any missing items within 48 hours, otherwise you understand and agree that you will lose the right to claim a refund for any missing items. Moreover, if you initiate a shipping claim for damaged items, you agree that carriers can take up to 10 business days to process a refund and that you also understand that claims for damaged packages due to carrier mishandling and or for any lost, stolen or damaged items from such claim, is the responsibility of the shipping company and if said company does not award your claim for any reason determined by them, you agree that you are still obligated to pay for the total amount of your invoice.
In the event that any action arising out of or relating to this agreement the customer agrees to consent to the exclusive jurisdiction of the federal and state courts located in Miami Dade County Florida. The parties waive any other venue to which either party might be entitled by domicile or otherwise.
AUTHORITY TO ENTER INTO AGREEMENT
You agree that by signing our invoice or clicking on our "I Agree" button that you enter into an agreement bound by these terms and conditions.
MERCHANDISE RETURNS (ALL AIRBAG SALES ARE FINAL & "NON AIRBAG" PRODUCTS HAVE A 30 Day Exchange Policy)
"NEW YORK CUSTOMERS ONLY" (IF YOU LIVE IN NEW YORK AND ARE REQUIRED TO FILE A 907 REBUILDABLE VEHICLE INSPECTION YOU SHOULD NOT PURCHASE AIRBAGS FROM OUR WEBSITE.) NY 907 INSPECTIONS REQUIRE THAT DEALERS OR INDIVIDUALES USE ONLY NEW AIRBAGS FOR REBUILDABLE VEHICLES. YOU ARE THEREFORE ADVISED THAT ALL PRODUCTS SOLD ON OUR WEBSITE ARE CONSIDERED USED OR NEW OVERSTOCK AND THEY WILL NOT QUALIFY FOR NY STATE DOT INSPECTION. IF YOU PURCHASE A USED OR NEW OVERSTOCK AIRBAG FROM OUR WEBSITE AND LATER DETERMINE THAT THEY CAN NOT BE USED TO PASS INSPECTION YOU UNDERSTAND AND AGREE THAT YOU WILL NOT BE ABLE TO RETURN THEM FOR REFUND OR EXCHANGE. ALL AIRBAG SALES ARE FINAL.
STATE DOT INSPECTIONS, ALTHOUGH WE PROVIDE VIN NUMBERS AND SERIALS NUMBERS AS REQUIRED TO PASS DOT INSPECTIONS IN MOST STATES., (EXCLUDES NY STATE) THERE ARE SOME STATES WHICH REQUIRE ADDITIONAL DOT REGULATIONS AND THEREFORE IT IS UP TO YOU TO CHECK FOR ANY NEW OR CHANGING LOCAL DOT LAWS WHEN INSTALLING USED OR NEW OVERSTOCK AIRBAGS FOR YOUR REBUILDABLE VEHICLE. IF YOU PURCHASE A USED OR NEW OVERSTOCK AIRBAG FROM OUR WEBSITE AND LATER DETERMINE THAT THEY CAN NOT BE USED TO PASS A DOT INSPECTION YOU UNDERSTAND AND AGREE THAT YOU WILL NOT BE ABLE TO RETURN THEM FOR REFUND OR EXCHANGE. ALL AIRBAG SALES ARE FINAL.
All merchandise returns are subject to the policies and guidelines set forth in the customer support tab and stated in the "Merchandise Return Policy" web page. AEI reserves the right to update the terms and conditions at any time without notice to you. All airbag shipments are sent out one way and therefore, we are not responsible for any call tags or pickups. Customer is responsible for confirming products purchased on-line. Products purchased via our online quotes or from our on-line inventory that reflect a part number, color, description, etc. are to be verified by the purchaser via a confirmation email sent to each respective customer. We charge a 25% restocking fees on non-defective (non airbag orders) returns or on canceled orders that have been shipped. Once the order is received by the customer, any transaction that includes any airbag products or class 9 charge is considered a final sale and therefore no returns are accepted. We will only accept cancellation orders in writing, either by fax, email, or text.
Customers agree to pay a $30.00 transaction fee if the following conditions apply. This fee is charged if an order is placed either via the internet or by telephone and then canceled after 7 business days. This fee also applies if items are purchased and held on orders waiting for modules to be sent by the customer and then canceled after 7 business days. Cancellations and or refunds are processed during our regular business hours, which is from 9:00 am - 5:00 pm M-F Eastern time. Any cancellations received after hours either by voicemail or email will be processed on the next business day. Credit Card transaction fees will be deducted for any refunds. Customers agree that orders completed through the website can only be delivered to the original shipping address as defined by the customer. In NO EXCEPTIONS can the package be rerouted to a different address or left at a pickup location. Customer agrees that an adult will be available to sign and take possession of said package and as per our contract the carrier will only make three attempts before the shipment is returned to our warehouse location. In the event this occurs the customer agrees that he/she... is responsible for any other shipping arrangements and will accept any cost involved for the new delivery. In addition, if the order is canceled, the customer agrees to pay a twenty five percent restocking fee, any transaction fees, and forfeits all shipping expenses of the original order.
Customer agrees not to hold AEI responsible for errors due to the negligence of the shipping company. If for any reason the carrier is at fault for any delays, including but not limited to bad weather, if the customer decides to cancel the order he/she... agrees to pay a twenty five percent restocking fee, any transaction fees and forfeits all shipping expenses of the original order.
Any and all discount offers must be presented before your order is completed or your transaction has been approved. All discounts are subject to terms as presented in the offer and no exceptions are made. If the discount is offered for online orders it must be initiated and applied on our website. Online offers are not accepted for telephone orders.
